- With summer just around the corner, most employers have already assembled an eager stock of interns willing to work over the next few months and gain some practical experience in the workplace. They are typically a perfect fit. The employer gets a free worker for a few months and the intern receives much needed experience to compete for jobs in the future. The U.S. Department of Labor (DOL), however, does not necessarily see it that way.
The DOL recently revisited a stringent test that must be met before an employer can properly classify an individual as an intern. If the test has not been met, then the employer should classify this person as a regular employee. The DOL and state wage and hour officials have said that they will soon begin cracking down on employers that misclassify interns.
